Did the shark do any steering or did he just lay his tail down on the gas pedal?

I guess it depends on gender. If the shark is male, he could've used his two willies hanging down to steer.

It didn't steer but it Cruise Control'd for Cool so maybe that counts as something?

As the shark "is standing next to the appropriate controls" (QuikLaws, Q.2.3, Siege Weapon) one might argue that the shark is a Minifig and the vehicle a Siege Weapon, as indicated by it's front design. It may be up to the opponent to proof the shark not "to be in good standing".

Based on BrikLaws I would probably argue that the construction is controled by an intelligent operator. In case the opponent starts to argue about the intelligence of a shark, Q.1.2 will apply.
